By engaging with Creatv Studio’s services, you agree to the following terms and conditions. Please read them carefully.

1. Services Offered

  • Web Design and Development
  • UX/UI Design
  • Digital Strategy and Consulting
  • Content Creation and Copywriting
  • Search Engine Optimization (SEO)
  • Hosting and Domain Registration
  • Maintenance and Support Services

2. Quotations and Estimates

  • All quotations are valid for 30 days from the date of issue.
  • Acceptance of a quotation constitutes agreement to these terms and conditions.
  • Any additional work or changes requested outside the original scope will be quoted separately and require written approval before commencement.

3. Payment Terms

  • A 50% non-refundable deposit is required before project commencement.
  • The remaining 50% is due upon project completion, prior to the final delivery or website launch.
  • For projects under R5,000, full payment is required upfront.
  • Retainer and monthly service fees are invoiced at the beginning of each month and payable within 7 days.
  • Late payments may incur a 6% monthly interest fee and could result in suspension of services until the account is settled.

4. Project Timelines and Client Responsibilities

  • Project timelines commence upon receipt of the deposit and all necessary content and materials from the client.
  • Clients are expected to provide all required content, feedback, and approvals in a timely manner.
  • Delays in client responses may result in adjusted delivery timelines.
  • If a project is inactive for more than 14 consecutive days due to client inaction, it may be deemed dormant, and a reactivation fee of R10,000 or 10% of the total project fee (whichever is greater) may apply.

5. Revisions and Approvals

  • The project includes up to two rounds of revisions. Additional revisions will be billed at R450 per hour.
  • Final approval must be provided in writing before the project is considered complete.

6. Hosting and Domain Services

  • Hosting and domain registration services are billed annually in advance.
  • Failure to renew hosting or domain services by the due date may result in suspension or loss of services.
  • Reactivation of suspended services may incur a reinstatement fee of R350.
  • Domain registration and renewal fees are non-refundable.

7. Maintenance and Support

  • Maintenance services are available through separate agreements.
  • Without a maintenance agreement, any updates, bug fixes, or support will be billed separately.
  • Clients are responsible for regular updates and backups if not under a maintenance plan.

8. Intellectual Property

  • Upon full payment, clients will own the final deliverables.
  • Creatv Studio retains the right to showcase completed projects in its portfolio unless otherwise agreed in writing.
  • All pre-existing intellectual property and tools used during the project remain the property of Creatv Studio.

9. Confidentiality

  • Both parties agree to keep all confidential information private and not disclose it to any third party without prior written consent.

10. Limitation of Liability

  • Creatv Studio is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services.
  • Our total liability is limited to the amount paid by the client for the specific service in question.

11. Termination and Cancellation

  • Clients may terminate services by providing 30 days’ written notice.
  • Upon termination, clients are responsible for all fees incurred up to the termination date.
  • Creatv Studio reserves the right to terminate services immediately if the client breaches any terms outlined herein.

12. Data Protection and Privacy

  • Creatv Studio complies with the Protection of Personal Information Act (PoPIA) of South Africa.
  • Personal information collected will be used solely for the purpose of delivering our services and will not be shared with third parties without consent.

13. Governing Law

  • These terms and conditions are governed by the laws of the Republic of South Africa.
  • Any disputes arising shall be resolved in the appropriate South African courts.

14. Amendments

  • Creatv Studio reserves the right to amend these terms and conditions at any time.
  • Clients will be notified of any significant changes.
